look to us as the regulator,

or how do we actually make it
so it's simpler for people to understand

if they've got a problem around

and those sorts of issues?

Is it straightforward?

I don't think it is
entirely straightforward.

I mean, this is why

when we gave our advice
in the white paper, we said we thought

there should be a statutory ombudsman

The Commission is not a big organisation in the scheme of things. Globally

as a regulator, we're quite a big gambling
regulator compared to other countries.

But not in really big numbers
00:18:50:22 - 00:18:52:11
And that's just because our market
00:18:52:11 - 00:18:55:11
is just more developed
and has been around for a long time
00:18:55:20 - 00:18:58:19
But we couldn't
be an ombudsman and I think

where do we draw the line?

I think we have to look at what
the overall strategic issues are.

So, withdrawals and transparency
for consumers about

why they've been asked to do something,
why they've been restricted?

why have they been stake factored?

You know, I saw a case recently
and I won't go
00:19:18:07 - 00:19:21:18
into the details for obvious reasons
where a consumer had been told
00:19:21:18 - 00:19:26:12
you've been subject to the Gambling
Commission mandated affordability check.
00:19:27:00 - 00:19:28:09
They hadn't.
00:19:28:09 - 00:19:31:02
Erroneous data
would come back from a different source.
00:19:31:02 - 00:19:34:06
Absolutely nothing to do with regulatory
requirements or the Gambling Commission.
00:19:34:20 - 00:19:37:20
And that customer was, frankly, misled.
00:19:37:22 - 00:19:40:11
And things like that
are muddying the waters,
00:19:40:11 - 00:19:42:23
and I think our job is,
00:19:42:23 - 00:19:45:05
is to drive things
00:19:45:05 - 00:19:48:05
forward in terms of clarity for consumers

but you could only take so far
because if there are money
00:19:51:21 - 00:19:56:03
laundering concerns, for example, or concerns
about fraud, which does come up

quite often,
then you can't tip off an individual,
00:20:00:07 - 00:20:03:01
well, I suspect you might be committing
fraud or suspect
00:20:03:01 - 00:20:04:02
you might be laundering money,
00:20:04:02 - 00:20:07:02
or I suspect this might be proceeds
of criminal activity.

And there's a proper process for that.

You know, there's fraud
intelligence units and there's obviously
00:20:13:12 - 00:20:16:05
general law enforcement as well as us.

So it becomes quite complicated

and I don't think anyone
00:20:20:15 - 00:20:23:15
should throw their hands up and go, well,
therefore we can't work it out.

It's just not straightforward.

What’s the industry’s role with it?
What would you say to someone

listening from the industry now in terms of withdrawals
and I.D checks?

They’ve got to be really clear, right,

So, I think the industry's got
I think it's got a couple of obligations.

One is, if you want lower friction
at the point of entry,

you cannot simply introduce
friction later on.

Right.

We’re really,
really clear about that.

So, you need to know who
your customer is, you’re required to

So you should be getting the information
you need at the beginning.

And doing that as a swiftly
and as

unintrusively
as you can, right, within reason,

I think the industry has got to be
really clear with consumers about

why it's doing certain things
and why it's asking for certain things.

I'm not sure there are many other sectors
where you get away with,

you know,
00:21:09:24 - 00:21:12:24
saying some of those, doing
some of those things like, well, I just,
00:21:13:01 - 00:21:14:20
you know,
I'm not going to take your business
00:21:14:20 - 00:21:17:07
now without any explanation
or I'm going to ask you
00:21:17:07 - 00:21:20:07
for a load of information
and not explain why.
00:21:20:15 - 00:21:22:08
And I don’t think the industry's
been very good at that.
00:21:22:08 - 00:21:23:11
Now, I say,

now I say that, and
I should step back a little bit, actually,
00:21:25:19 - 00:21:29:04
because I do think one of the problems
for the gambling industry
00:21:29:15 - 00:21:33:07
is it gets treated
as a single homogenous industry.
00:21:33:08 - 00:21:36:24
And it isn't, it isn't, so we license
00:21:37:14 - 00:21:40:01
I looked the other day in a conversation,
I think it's,
00:21:40:01 - 00:21:45:14
I think there were 2702 or something
licensees that were on the register.
00:21:45:14 - 00:21:47:18
Now some of those will be really tiny
00:21:47:18 - 00:21:51:08
and some of them will be the huge groups
you know, that we know about.
00:21:51:09 - 00:21:52:00
Right?
00:21:52:00 - 00:21:57:08
50% of gross gambling yield is, you know,
in the hands of 3 or 4 of those groups.
00:21:57:08 - 00:21:58:11
So we've got to be careful
00:21:58:11 - 00:22:02:10
not to say “the industryâ€
because not everyone does it all the time.

But I do think the industry generally
hasn't been very good at this.

And I think it's
I think it's hidden behind at times

blaming the regulator because we can't
comment on individual cases.

So it gets really difficult to say,
no, that's not true.

Now, I don’t think that's really about
defending the reputation of the regulator,

because I don't think
that should be our key focus.

But I do think consumers are owed

better explanations
as to why things are happening for them.

So, more transparency
in terms of the process and what it’ll look like?

Well, why? Why are you being asked for something?
00:22:36:21 - 00:22:40:04
There will be times when you can't say
something but
00:22:40:04 - 00:22:41:15
It's not all the time.
00:22:41:15 - 00:22:45:00
And I've seen too many cases
where it's not
00:22:45:21 - 00:22:48:22
It's not something they
they were unable to say anything about.
00:22:48:23 - 00:22:51:06
I just think it needs to be better.

And I think that needs to mature
a bit within the industry.

So, I suppose if you've got consumers

who are then frustrated, as you said,
we're not the ombudsman

we don't deal with the complaints,
00:23:06:09 - 00:23:10:06
is it the best route for those complaints
to go through
00:23:10:06 - 00:23:12:11
an alternative dispute resolution say?
00:23:12:11 - 00:23:14:08
I mean,
what that is, that is how the system works
00:23:14:08 - 00:23:18:20
So firstly you should exhaust the complaints
process for the operator, because,
00:23:19:11 - 00:23:24:02
an ADR will generally refer you back
if you haven't done that.
00:23:24:15 - 00:23:27:15
So, it's not something
you escalate to straightaway.
00:23:27:20 - 00:23:28:21
You should exhaust that
00:23:28:21 - 00:23:32:01
then you should go to an ADR
and one of the things as I said earlier
00:23:32:01 - 00:23:36:18
on, we've said there should be
an ombudsman that deals with these issues
00:23:36:18 - 00:23:41:02
and also social responsibility issues,
because that doesn't exist at the moment.

And that's something the government said
it would take forward
00:23:44:10 - 00:23:46:18
from the White Paper,
and we'll wait and see what happens.

But yeah, consumers

should be going to an ADR
if they've not had a satisfactory answer

from the operator.

So if you go back to the fair and open
discussion, then in terms of technology

and how that's now
going to change the landscape

and things like AI, for example,
and how that, sort of, is going to be
00:24:06:09 - 00:24:09:16
a massive change, not just for gaming
and gambling for every industry.

I suppose.

What sort of challenges
does that pose for us as a regulator?
00:24:13:21 - 00:24:17:24
And, you know, the industry is forging
ahead and evolving at a rapid rate.
00:24:17:24 - 00:24:19:21
How are we keeping up with
that sort of stuff
00:24:19:21 - 00:24:22:16
especially thinking
with our fair and open hat on?
00:24:23:18 - 00:24:27:04
So there's
a couple of things going on around AI
00:24:27:04 - 00:24:29:13
operators use of AI at
00:24:29:13 - 00:24:33:21
the moment is mostly around
trying to drive consistency,
00:24:35:05 - 00:24:37:03
of things like interventions.
00:24:37:03 - 00:24:40:03
So, not necessarily interventions by AI,
00:24:40:05 - 00:24:44:04
but understanding through use of AI
and its ability to simulate
00:24:44:04 - 00:24:46:08
large amounts of information very quickly,
00:24:46:08 - 00:24:48:07
whether or not
their approach is consistent.
00:24:48:07 - 00:24:50:17
I think that feels like
a pretty sensible thing.
00:24:50:17 - 00:24:54:10
There are other applications,
I think that will start to come along around AI
00:24:54:10 - 00:24:58:14
in terms of, you know, how
they improve their margin, etc.
00:24:58:14 - 00:25:00:21
I'm not quite sure how that will work yet.

There are examples of bots
being used on the consumer side of things,
00:25:05:09 - 00:25:08:08
which I think would really affected
certain products.

There's a lot of talk,
I don't know, it wouldn't be our space,
00:25:12:14 - 00:25:16:05
but I don't know what this looks like
in full reality.

But there's a lot of talk about,
00:25:19:15 - 00:25:23:17
poker and bots and how that's influenced online
poker.
00:25:23:17 - 00:25:27:06
Certainly counterparts in Europe
have talked about, bots
00:25:27:06 - 00:25:30:06
and AI being used around betting,
00:25:30:21 - 00:25:33:16
on multiple lines, multiple accounts.
00:25:33:16 - 00:25:37:04
There's been recent National Crime
Agency alerts about,
00:25:38:13 - 00:25:40:24
identity spoofing through AI.
00:25:40:24 - 00:25:44:13
So people paying for services
will spoof a load of documents
00:25:44:13 - 00:25:48:08
for you to try and get around KYC
and things like that.
00:25:49:06 - 00:25:51:11
That I think
is going to pose loads of challenges
00:25:51:11 - 00:25:54:11
because when you start to think
about that, it's starting to attack
00:25:54:14 - 00:25:57:14
the very core of ‘know your customer’
00:25:58:06 - 00:26:01:06
and how does the operator know
00:26:01:13 - 00:26:04:00
that they're really dealing
with the person they think they are?
00:26:04:00 - 00:26:06:01
That opens up all kinds of other risks.
00:26:06:01 - 00:26:07:06
And I think that's going to be an effort
00:26:07:06 - 00:26:10:07
that's far wider than just
the Gambling Commission.
00:26:11:02 - 00:26:13:21
And I think our, our own work
around technology
00:26:13:21 - 00:26:16:21
and data and insights
been growing in the last few years.
00:26:17:01 - 00:26:19:19
We've been investing heavily in research
00:26:19:19 - 00:26:22:19
insight, our understanding of technology,
00:26:22:22 - 00:26:27:24
trying different, approaches
and iterating different things around
00:26:28:21 - 00:26:32:13
information
and how we can get a more accurate
00:26:32:13 - 00:26:35:21
picture of what's happening
and detect things much earlier.
00:26:36:09 - 00:26:41:01
and I know, people have been critical
of the Gambling Survey for Great Britain
00:26:41:01 - 00:26:45:08
but it's a massive step forward compared to the health survey
00:26:45:08 - 00:26:47:03
which was excellent in its time
00:26:47:03 - 00:26:49:08
we're able to see things far more
00:26:49:08 - 00:26:52:08
frequently at a higher level,
greater granularity.
00:26:52:10 - 00:26:56:12
There aren't multi year gaps
between surveys,
00:26:56:13 - 00:27:00:03
there isn't a year long gap
between the field work and the outputs.

That's giving us a tremendous amount.

The analysis that we've done
around open banking data,

and what that's telling us about consumers

real patterns of behaviour
is really insightful and important

and I think we need to be doing more
and more of that,

because we have to have a really refined
understanding of what's going on

so that we aren't taking a really broad
brush

to risks, we're looking,
00:27:24:03 - 00:27:27:21
you know, we identify what they are
and look for them in specific places.

And I think that's
00:27:29:01 - 00:27:32:15
what the future regulation will be
is much more targeted intervention.

And that really is what sits behind
financial risk checks as well, which again

been talked about a lot, very heavily
criticised in certain quarters.

But what that is actually about
is utilising available data and technology
00:27:46:07 - 00:27:51:21
to, to not actually ask people questions
where they don't need to be asked
00:27:52:04 - 00:27:54:21
it’s to remove friction that exists
00:27:54:21 - 00:27:57:21
in the system now,
which is quite an analogue approach
00:27:57:21 - 00:28:01:17
to something that would be more accurate,
more reliable, far less intrusive.

And I think that is
where all of this is, is going to.

You will always have a counterbalance
of people's privacy concerns.

And that, I think, is,

you know, a fairly
00:28:12:18 - 00:28:15:18
obvious challenge for people in this day
and age.

And I don't, you know, I,
I don't think it's for me to figure out

the answers to all of that, but
I think it's going to continue to test us.

So as we come to the end of this

I mean, I think I’d start with;
there are three objectives at the Commission

three licensing
objectives, the Commission’s got

I think there was a, in years gone by
and, I think for understandable reasons,

a much heavier emphasis
on the one about protecting the vulnerable.

And that's not to say that you stop doing
that in order to do the others.

What we've been able to do with
the changes we’ve made to resourcing
00:29:06:18 - 00:29:10:19
is try to focus much more evenly across
those three objectives.

So on the fair and open objective, it's
recognising

there's far more tension and far more,
00:29:18:07 - 00:29:20:00
I think

unwanted contact and friction

within the overall system
that supports gambling

so things like withdrawals, restrictions,
factoring and things like that,

which is a balance between the industry
protecting itself from certain things
00:29:34:18 - 00:29:37:18
but it shouldn't be disadvantaging
consumers unfairly.

And that's what we're really focused
on, is not trying to,

manage the market, that isn't our job,
but to make sure
00:29:47:07 - 00:29:50:22
that the industry is behaving responsibly
and it's transparent.

That's really where our focus is

Whilst we don't deal with individual
cases, doesn't mean we don't look at them.

I mean, I've personally looked
at quite a lot of cases

which, whilst I don't think it's
for me to intervene and fix them,

I think it is important

to see what the examples are
and what story they're really telling us.

There's a long way to go on this yet

and I've been quite open in public
with the industry about my challenge

to it and, sort of, what I expect it to do
in terms of transparency.

That hasn't happened yet.

But that

just means that
we will do something to make it happen.
